1.1 These Terms apply to goods bought from 53degreesnorth.ie. "We", "us" and "our" means Kintbury Limited, trading as 53 Degrees North, a company registered in Ireland (company number 124426) with its registered office at B4 Riverview Business Park, Dublin, D12 H291, Ireland. VAT number IE4816744K. "You" means the person buying Goods from us. "Contract" means the contract between us for the sale and purchase of the Goods, which incorporates these Terms. "Goods" means the products you buy from us.
1.2 These Terms form part of the Contract between us. Nothing in these Terms affects your statutory rights as a consumer.
2. Price
2.1 Prices on our website include VAT.
2.2 Delivery charges are shown separately at checkout before you pay.
2.3 Published prices may change, but the price you pay is the price shown when you place your order.
3. Ordering goods online
3.1 You confirm that the information you give us when ordering is accurate and complete and relates to you or the person placing the order.
3.2 When an order is made online, the payment confirmation issued by the company processing your card payment does not by itself constitute acceptance of your order by us. We reserve the right to check any discrepancies, and an order will be confirmed as soon as reasonably practicable and in any event before delivery of the Goods.
3.3 If an error in the ordering process, such as an obvious pricing error, is caused by technical or other reasons beyond our control, we may decline the order. If we do, we will tell you and refund any payment in full.
4. Privacy
How we use your personal information is set out in our Privacy Policy.
5. Payment
5.1 Payment for Goods and delivery must be made before the Goods are dispatched.
5.2 Delivery will not take place until payment has been received in full.
6. Delivery
6.1 We will give you an estimated delivery date. Unless we agree otherwise, we will deliver your Goods within 30 days of your order.
6.2 We will arrange packing and choose the delivery method.
6.3 If your Goods appear to be damaged in transit, please tell us as soon as possible and keep the packaging, as it may be needed for a claim. This does not affect your statutory rights.
7. Risk and ownership
7.1 The risk of loss or damage to the Goods passes to you when you, or a person you have nominated (other than the carrier), take physical possession of them. If you collect the Goods from us, risk passes to you on collection.
7.2 Ownership of the Goods remains with us until we have received full payment.
8. Your right to cancel
If you bought online, you can cancel within 14 days of receiving your order without giving a reason. How to cancel, and how refunds work, is set out in our Refund Policy and on our Returns & Exchanges page. This right is in addition to our 30-day returns policy.
9. Faulty goods and liability
9.1 The Goods must match their description on our website and conform to the Contract.
9.2 If Goods are faulty or not as described, you have rights under the legal guarantee of conformity, which lasts for a minimum of two years from delivery. Please contact us at webstore@53degreesnorth.ie with your order number and details of the fault. How to return faulty items is set out on our Returns & Exchanges page.
9.3 We are not responsible for normal wear and tear, accidental damage, or damage caused by not following the care instructions supplied with the Goods.
9.4 We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, and your statutory rights in relation to faulty Goods.
10. Contacting us
You can contact us by email at webstore@53degreesnorth.ie, by phone on +353 1 4372707, or by post to our registered office above.
11. Customer default
If you give us incorrect personal information, fail to make a payment when due, or cancel a payment, we may cancel the Contract. If we do, we will refund any payment we have received for Goods not supplied.
12. Events outside our control
We are not liable for delays or failures caused by events outside our reasonable control, such as fire, flood, severe weather, war, internet disruption, power failure or strikes. If such an event prevents us from delivering your order, we may cancel or suspend the Contract. If we cancel, we will refund any payment for Goods not supplied.
13. General
13.1 If any part of these Terms is found to be unenforceable, the rest of the Terms will still apply.
13.2 We may transfer our rights and obligations under the Contract to another organisation. This will not affect your rights under the Contract.
14. Disputes and governing law
14.1 If you have a complaint, please contact us first and we will try to resolve it.
14.2 These Terms are governed by Irish law. Any dispute may be brought before the Irish courts. If you live elsewhere in the EU, you may also be entitled to bring proceedings in your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. The Terms that apply to your order are the ones published on our website when you placed it.
